Terms of Service

1. Acceptance of Terms
By downloading, installing, or using Yapme ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.
These Terms form a legally binding agreement between you and Chidurala Technologies, an ASIC-registered sole trader based in Parramatta, New South Wales, Australia ("we", "us", "our").
2. About Yapme
Yapme is an anonymous, location-based social app that lets you post short text messages ("yaps") visible to people nearby. Posts are ephemeral — they are automatically deleted after 24 hours.
3. Eligibility
You must be at least 18 years old to use Yapme. By creating an account, you confirm that you are 18 or older.
If we discover that an account belongs to a person under 18, we will terminate that account without notice.
4. Account Registration
To use Yapme, you must register with a valid email address and a username. You agree to:
- Provide accurate information when registering.
- Keep your password confidential and not share it with others.
- Notify us immediately if you suspect unauthorised access to your account.
- Maintain only one account. Creating multiple accounts to circumvent a suspension or ban is prohibited.
You are responsible for all activity that occurs under your account.
5. Content Rules
You may only post content that complies with these Terms. You must not post content that:
- Harasses, threatens, or intimidates any person.
- Is defamatory, discriminatory, or vilifies any person or group on the basis of race, ethnicity, religion, gender, sexual orientation, disability, or other characteristic.
- Is sexually explicit or pornographic.
- Depicts, promotes, or facilitates violence or self-harm.
- Is spam, commercial advertising, or deliberately deceptive.
- Violates the intellectual property rights of any third party.
- Violates any applicable Australian or international law.
We reserve the right, but are not obligated, to remove content that we determine in our sole discretion violates these Terms or is otherwise harmful.
6. Ephemeral Nature of Content
All posts are automatically and permanently deleted from our servers after 24 hours. Replies are deleted when their associated post is deleted. You should not post anything you wish to preserve. We make no representation that content will be available for any specific period of time before its scheduled deletion.
7. Prohibited Conduct
In addition to prohibited content, you must not:
- Use the App to solicit personal information from minors.
- Attempt to identify or dox other users based on their posts.
- Use automated tools, bots, or scripts to create posts or interact with the App.
- Attempt to interfere with, disrupt, or gain unauthorised access to our systems.
- Circumvent, disable, or otherwise interfere with any security or access control feature of the App.
- Use the App for any unlawful purpose.
8. Reporting, Blocking, and Moderation
Reporting: If you encounter a post that violates these Terms, you can report it using the in-app report function. We will review reports and take action where we determine a violation has occurred, which may include removing content or suspending or terminating accounts. We do not guarantee any particular response time. Moderation decisions are made at our sole discretion and we are not obligated to take action on every report.
Blocking: You can block any user. Blocked users will not see your posts and you will not see theirs.
Muting: You can mute any user. Muted users will not see your posts in their feed, but you will still see theirs.
9. Yapme+ Subscription
Yapme+ is an optional paid subscription available through Apple's App Store. By purchasing Yapme+, you agree to:
- These Terms and Apple's Media Services Terms and Conditions.
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
- Manage and cancel subscriptions through your Apple ID account settings.
Subscription pricing is displayed at the time of purchase. Prices may change with notice.
Yapme+ is available on iOS only. Subscription features include: editing your posts within 30 minutes of posting, and a private visual indicator on your own posts visible only to you.
Refunds are subject to Apple's refund policies. We do not independently process refunds for App Store purchases.
10. Intellectual Property
Your content: You retain ownership of the content you post. By posting on Yapme, you grant us a non-exclusive, royalty-free, worldwide licence to store, transmit, and display your content to the extent necessary to operate the App. This licence ends when your content is deleted (including at the 24-hour expiry).
Our property: The Yapme name, logo, and application code are owned by Chidurala Technologies. You may not copy, modify, distribute, or create derivative works from them without our express written permission.
11. Disclaimers
The App is provided "as is" and "as available" without warranty of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:
- The App will be uninterrupted, error-free, or free from viruses or other harmful components.
- Content posted by other users is accurate, lawful, or appropriate.
- Any particular post or content will be available for any minimum period before deletion.
To the maximum extent permitted by applicable law (including the Australian Consumer Law), we disclaim all warranties not expressly stated in these Terms.
Nothing in these Terms excludes any rights you have under the Australian Consumer Law that cannot be excluded.
12. Limitation of Liability
To the maximum extent permitted by law, our total liability to you for any loss or damage arising from your use of the App is limited to AUD $100 or the total amount you have paid us in the 12 months preceding the claim, whichever is greater.
We are not liable for:
- Any loss of data, including user-generated content.
- Any indirect, incidental, special, consequential, or punitive damages.
- Content posted by other users.
- Interruptions to the App's availability.
13. Indemnification
You agree to indemnify and hold harmless Chidurala Technologies from any claim, loss, damage, liability, or expense (including reasonable legal fees) arising from: (a) your use of the App; (b) your violation of these Terms; or (c) content you post on the App.
14. Account Termination
By you: You may delete your account at any time from Settings → Account → Delete account. Deletion is immediate and permanent.
By us: We may suspend or terminate your account at any time, with or without notice, if we determine you have violated these Terms, engaged in conduct harmful to other users, or for any other reason at our discretion.
Upon termination for any reason, all your posts and account data are deleted in accordance with our Privacy Policy.
15. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of New South Wales and the Federal Court of Australia.
16. Dispute Resolution
If you have a dispute with us, we encourage you to contact us first at privacy@yapme.com.au to seek resolution informally. We will make reasonable efforts to resolve disputes within 30 days.
If informal resolution fails, disputes will be resolved through the courts of New South Wales as set out in Section 15.
17. Severability
If any provision of these Terms is found to be unenforceable, that provision will be modified to the minimum extent necessary to make it enforceable, and the remaining provisions will continue in full force.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Chidurala Technologies regarding your use of Yapme.
19. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you through the App before the changes take effect. Your continued use of the App after the effective date of any changes constitutes your acceptance of the revised Terms.
